You’ll get an on-the-spot fine of $250, which doubles if you’re within a designated children’s area, with a maximum fine of $1,100 after appeal.
It’s also illegal to smoke an electronic cigarette/vape in a car with a child under 16 years.

In Victoria it is illegal to smoke cigarettes or e-cigarettes in your car with a child under the age of 18. The law passed in 2010, and applies whether the car is moving or not. The maximum penalty is over $500.
Is it illegal to smoke in your car in Queensland?
In Queensland it is illegal to smoke or vape in your car with a child under the age of 16. When the law was passed in 2010, there were 276,000 Queenslanders with children aged under 16 who smoked. That number has hopefully dropped since, but the on the spot fine of over $300 hasn’t!
It’s also illegal in Queensland to smoke in your car if it’s being used for business and there’s more than one person in the car.

In South Australia it is illegal to smoke in your car with a child under the age of 16. The surprisingly progressive state was the first in Australia to pass the law. If caught smoking or vaping in a car, you’ll be up for a $105 fine, up to a maximum of $750.

In The Northern Territory it is illegal to smoke in your car with a child under the age of 16. Unlike their southern neighbours, the Northern Territory was relatively late to the party, passing laws in 2014, making it the last state or Territory to do so. You’ll get an on-the-spot fine of around $300 if you break the law – a magistrate could increase that to around $3,000!

In Tasmania it is illegal to smoke in your car with a child under the age of 18. Tasmania passed the law in 2008, making it the second state to do so. It’s also illegal to smoke in work vehicles when there are two or more people present.

In Western Australia it is illegal to smoke in your car with a child under the age of 17. The laws came into force in 2010 as part of legislation outlawing smoking in a range of public places, including some beaches, alfresco dining areas, and near playgrounds. Offenders are open to a $200 on the spot fine and a $1,000 court fine.

In Canberra it is illegal to smoke in your car with a child under the age of 16. The Australian Capital Territory has some of the harshest punishments for non-compliance – you could receive an on-the-spot fine of $250, which can be increased to $5,500 in court.
